The situation at the Lajat factory in Gomez Palacio is becoming dangerous for the workers as the company continues, with impunity, to violate their rights and your code of conduct for suppliers. Don't stand passively by and watch while Lajat and the local labor authorities blatantly violate workers' rights.

Lajat's treatment of its workers by closing the plant, cutting their wages, not paying the health care benefits, physically attacking them, and threatening them with a blacklist is unconscionable.
It is dismaying to see that your company is conducting business as usual with a supplier that blatantly violates contracts you have signed with them. Your company's image is at risk by continuing to tolerate production of jeans in sweatshops like Lajat.

One worker, with 11 years seniority producing blue jeans at Lajat Gomez, has a child with birth defects who cannot get the oxygen she needs because her father now makes only $35 a week and has no health coverage. Please act now, as the workers are suffering dire consequences due to your negligence.

Demand that Lajat reopen the Gomez Palacio plant with all the workers returned to work at full pay and that they stop their interference in the workers' fundamental human right to freedom of association.

Estamos muy preocupados por la impune violación a los derechos laborales de las y los trabajadores de Manufacturas Lajat en Gomez Palacios, Durango. Los cuales demandaron la titularidad del contrato colectivo al sindicato que lo sustenta. La empresa, y las autoridades laborales conjuntamente, han incurrido en una serie de violaciones a sus derechos en cuanto a la libre asociación. Incluso la empresa acordó cerrar la planta temporalmente para evadir las elecciones sindicales. Los trabajadores demandaron el embargo precautorio y hasta el momento la Junta de Conciliación y Arbitraje no ha respondido a sus demandas. Los trabajadores han padecido desde violaciones a sus derechos hasta amenazas, sobornos, listas negras, incluyendo violencia física contra una trabajadora por parte del gerente. La JCA el 7 de octubre dio curso a la audiencia, sin haber notificado a los trabajadores, y la empresa les negó el permiso a los trabajadores para que asistieran.

Hace 12 años el TLCAN llegó con la promesa de que los derechos humanos y laborales serían respetados, sin embargo el caso de los trabajadores de Lajat es un ejemplo irrefutable de esta constante violación. Si bien es verdad que este asunto es de competencia local y estatal. También es cierto que estas prácticas son producto de sus políticas comerciales las cuales garantizan la impunidad de las multinacionales a costa de los derechos de las y los trabajadores.

Urgimos que intervenga para que las y los trabajadores de Lajat en Gómez Palacio obtengan Justicia.

We are concerned about the blatant violation of workers rights occuring in Gomez Palacio, Durango in the case of the Lajat workers who have petitioned the Conciliation and Arbitration Board to establish representation by their union, the National Union of Garment and Clothing. The company, the local CAB and the CTM have all conspired to violate the Federal Labor Law to insure that these workers remain under total control even to the extent of closing the plant as a pretext to avoid an election. There has been a variety of illegal activity including use of a blacklist, threats, bribes and even violence against workers by a supervisor. Yet the local CAB doesn't even bother to have an appearance of neutrality. It held hearings without notifying the workers' legal representatives and without allowing them to speak.
Please intervene. It is now almost twelve years since the implementation of NAFTA in which your government promised to respect worker rights and its own labor laws, but the situation at Lajat belies this. We urge you to intervene to help these workers obtain justice.

De la manera más atenta estamos solicitando su intervención para hacer llegar a la Secretaria de Relaciones Exteriores y al gobierno del estado de Durango nuestras preocupaciones y demandas.

Los trabajadores de Manufacturas Lajat en Gómez Palacio Durango, han venido padeciendo durante estos nueve meses una constante violación a sus derechos laborales. Los trabajadores demandaron el pago del tiempo extra que Lajat ha evadido, así como el monto de las aportaciones al INFONAVIT que les ha deducido de su salario y no ha cubierto en dicha institución. Así como las aportaciones al IMSS.

La Junta de Conciliación y Arbitraje de Gómez Palacio ha hecho caso omiso a sus solicitudes. Todo lo contrario los trabajadores fueron despidos injustificadamente y solamente a través de nuestra intervención con los clientes de Lajat, como es Levi's, fue posible que les reinstalaran. Los trabajadores solicitaron su sindicato, el cual les fue negado por la Junta con argumentos ridículos. Posteriormente demandaron la titularidad del contrato colectivo y la Junta dolosamente dicto fecha de audiencia y recuento al mismo tiempo. La empresa acordó cerrar la planta temporalmente para evadir las elecciones sindicales. Lajat intentó sacar químicos y materiales, pero los trabajadores lo impidieron, y recortó a 350 pesos el salario para presionarles. Por lo tanto, los trabajadores solicitaron el embargo precautorio y hasta el momento la Junta no ha respondido el proceso.

El 7 de octubre tuvieron una audiencia del proceso del recuento sindical por la titularidad del contrato, y dentro de ella, ninguno de los dos representantes de los y las trabajadores fue dado paso para hablar. Este aplastamiento de las voces de los trabajadores, junto con las declaraciones de CANACINTRA, en el periódico La Opinión el 30 de septiembre, que se están implementando los acuerdos de la alianza entre la CTM, Lajat y los tres niveles de gobierno, nos hace entender que quieren impedir que los trabajadores se organicen democráticamente. También, éste nos hace comprender los antecedentes del compartimiento del Lic. Francisco Javier Covarrubias Presidente de la Junta de Conciliación de Gómez Palacios Durango, quien ha hecho caso omiso a la solicitud de los trabajadores.

Los trabajadores han padecido desde violaciones a sus derechos hasta amenazas, sobornos, listas negras, incluyendo violencia física contra una trabajadora por parte del gerente. Como personas dedicadas a los derechos humanos, queremos que los trabajadores de Lajat obtengan la justicia. Como nuestra coalición seguirá apoyando a las trabajadoras hasta que ganen justicia, hasta los clientes, Levi's, Mudd Jeans, y Aeropostale, presionarán a Lajat para conformidad con sus códigos de conducta o cancelan los contratos en México, nos parecen que los intereses del gobierno de México están en la aplicación de la ley y los estándares internacionales.

Solicitamos que la Secretaria de Relaciones Exteriores se comunique inmediatamente con el Gobernador de Durango Ismael Hernández Deraz y le haga saber de nuestra preocupación además de nuestras demandas:

1. Que la Junta de Conciliación y Arbitraje de Gómez Palacios Durango actué conforme a derecho y les de la fecha para el recuento sindical
2. Que Manufacturas Lajat les regrese sus empleos con salarios completos
2. Que la Junta de Conciliación y Arbitraje les de la fecha del embargo precautorio para garantizar indemnización por trabajadores en caso del cierre completo de la fábrica
3. Que Manufacturas Lajat respete el derecho a la Libre sindicalización de los trabajadores
4. Que las elecciones sindicales sean en un lugar neutral [plaza pública] y con voto secreto

The workers of Lajat have experienced constant violations of their labor rights, and are demanding the back pay that they are owed by the factory as well as their social security.

The Conciliation and Arbitration Board of Gomez Palacio has not responded to this crisis; instead the workers were unjustifiable fired for asserting their rights and only because of our intervention, as an international solidarity movement in support of the workers, were they reinstated. The workers have attempted to register their union, but have been denied by the CAB repeatedly. In the meantime, the company has tried to close the factory, cutting pay to 350 pesos a week. Because of this the workers have asked for an precautionary embargo of the factory's assets in the case that it does close, but the CAB has not responded to this request.
On October 7, there was a hearing to determine the legitimacy of the workers' application for union recognition, but neither of the workers' representatives present was given permission to participate. This silencing of the workers' voices shows us that the company, the company union and the government at various levels are trying to impede the workers from organizing democratically.

The workers have suffered various violations, including threats, bribes, blacklists, and even physical violence on the part of one of the management. As people dedicated to human rights, we want to see these workers obtain justice. Our coalition will continue to support the workers, pressuring the clients of the Lajat factory, which invest in Mexico, and wish to see their suppliers abide by the local law and international standards.

We ask that you immediately communicate to the Governoer of Durango the workers' demands:

1. That the CAB abide by the law and allow a union election
2. That Lajat reinstate all the workers at full salary
3. That CAB issue a precautionary embargo of Lajat's assets
4. That Lajat respect the workers' right to the freedom of association
5. That the elections take place in a neutral location with a secret ballot
